Abstract Sun Yat-sen has abundant thoughts of constitution. He put forward the thought of the five-power constitution by using the successful experiences of other countries and expressed his core ideas on the examination power being independent of the other four rights The discretion, implementation, supervision of Civil Service Exam have not been separated currently, the examination bodies also have not been separated from Executive Power, their link is partly unscientific and unreasonable, the related laws are imperfect and regulatory mechanisms are inadequate. This paper mainly studies how to employ Sun Yat-sen' Independent Examination Power in enhancing the restriction of the power to assure the protection of the test takers' rights at the same time.
