不成文的构成要件要素之新探

摘要 不成文的构成要件要素是指刑法未明文规定,但又为成立某一犯罪所必须的要素。确立不成文的构成要件要素并不意味着违反罪刑法定原则,反而有利于实现罪刑法定原则实质侧面的功能。不成文的构成要件要素具有区分罪与非罪、此罪与彼罪的功能。合理确定不成文的构成要件要素,可以借鉴注意规定的确定方法。另外,根据条文的内在逻辑以及条文之间的关系也可以确定不成文的构成要件要素。

Abstract: Unwritten elements in constitutional requirements are the elements not written in the criminal law but essential to the constitution of certain crimes. Confirming the existence of unwritten elements doesn’t mean violating the legal principle of crime and punishment. On the contrary, it helps realize the function of the substantive side of this principle. Unwritten elements have the function of judging whether an act constitute a crime and distinguish a crime from another. To reasonably define unwritten elements, we can use the determination method of provisions for attention for reference. Besides, according to the inner logic of provisions and the relationships between them, we can also define unwritten elements.
